Please be aware of Harbes Farms Terms & Conditions and Safety Rules
By entering any Harbes Farms property, or purchasing Ticket(s) or Season Pass(es), I agree to be bound by Harbes Farms’ posted Terms of Purchase. I understand that all sales are final, there are no refunds or exchanges.
Harbes Farms’ Terms & Conditions:
The following terms and conditions apply to all persons entering any Harbes Farms property(ies), or guests who purchase Season Pass(es), and any day tickets (“Tickets”) including combo tickets. By entering any Harbes Farms property or purchasing a Ticket or Season Pass, you are deemed to have accepted these Terms and Conditions of use.
- You acknowledge and agree to assume the inherent risks associated with attendance at Harbes Farms and the use of all attractions, and agree to read and obey all safety signage, instructions and rules. Such risks include bodily or physical injury or harm or death that may be caused by or arise or result from or be attributable to the use of or participation in or on any attraction, particularly for those for whom normal operation of any attraction may be hazardous, including those who are pregnant, have a heart condition, have neck or back problems, or have other health problems that may make them more vulnerable to injury. Other risks of attending large outdoor venues include, injuries from exposure to the elements, such as rain, cold, excessive heat or the weather in general, and injuries or illness sustained due to your own personal negligence and/or the negligence of others, including running, jumping, engaging in altercations with other patrons or otherwise behaving recklessly at the Farm, and illness resulting from your failure or the failure of other patrons to abide by our health declaration policies. You are responsible to know your own health and physical condition and limitations and the health and physical condition and limitations of any minor under your care or supervision. If you use, or you permit any minors under your care or supervision to use, any attraction, you or they do so at your or their own risk. Harbes Farms assumes no responsibility for accident or loss to any person in connection with the condition or use of the Farm and attractions or their entrance into or departure from the Farm. You hereby irrevocably release Harbes Farms and its affiliates and their respective employees, agents, representatives, contractors, subcontractors, successors, heirs, and assigns from, and hold them harmless for, all losses, damages, costs, expenses, claims, demands or causes of action whether known or unknown, suspected or unsuspected, arising out of your attendance at, and use of, the Farm, except to the extent caused by Harbes Farms’s gross negligence or willful misconduct.
- Pursuant to New York State Law GOL Section 18-303(1)(c), owners and operators of both agricultural tourism areas and pick-your-own areas, shall not be liable for an injury to, or death of a visitor, in both the agritourism activity and the harvesting of agricultural products conducted at this location if such injury, death, damage, or loss results from the inherent risks of the agritourism activity and/or the harvesting of agricultural products. Inherent risks include, but shall not be limited to, risks of injury inherent to land, waters, the ordinary dangers of structures or equipment ordinarily used in farming operations, domestic and wild animals, as well as the potential for you to act in a negligent manner that may contribute to your injury or death and the potential of another visitor to act in a negligent manner that may contribute to your injury or death. You are assuming the risk of participating in this agritourism activity and/or harvesting of agricultural products.
- By purchasing an admission ticket(s) and in consideration thereof, and in consideration for being able to visit and/or participate in attractions, transportation, and activities at Harbes Farms, I agree, understand, and acknowledge, on my own behalf and on behalf of any individual who uses a ticket, pass, or reservation made by me, as follows:
I acknowledge that an inherent risk of exposure to the disease COVID-19 and any other communicable or infectious disease, exists in any public place where people are present. I acknowledge that the risk of exposure to COVID-19 and any other communicable or infectious disease includes the risk that I will expose others that I later encounter, even if I am not experiencing or displaying any symptoms of illness myself. By visiting and/or participating in attractions, transportation, and activities at Harbes Farms, I agree to voluntarily assume any and all risks in any way related to exposure to COVID-19 and any other communicable or infectious disease, including illness, injury, or death of myself or others, and including without limitation, all risks based on the sole, joint, active or passive negligence of any of the Released Parties, named below. I acknowledge that my visit and participation are entirely voluntary.
On my own behalf and on behalf of my heirs, executors, personal representatives, administrators, and assigns, I agree to forever waive, covenant not to sue, release, and discharge the Released Parties, named below, from any and all liability, claims, causes of action, damages, costs, or expenses of every kind, including all claims and causes of action based on the sole, joint, active or passive negligence of any of the Released Parties, arising out of or in any way relating to exposure to COVID-19 and any other communicable or infectious disease during my visit to and/or participation in attractions, transportation, and activities at Harbes Farms. This waiver of liability and the assumption of risk set forth above is intended to be as broad and inclusive as is permitted by law.
Harbes Farms’ Safety Rules
To ensure a safe and enjoyable experience for all of our farm guests, please respect the following rules:
Guest Safety: Harbes Farms takes great pride in its attention to guest safety. Equipment and many activities are monitored and regularly inspected and employees are trained to monitor guests for safety. However, employees are not intended to be the only supervisors of guests, especially children. All attractions and activities are intended for those in good health to partake in at their own and parental discretion, according to their abilities and at their own risk.
Age policy: Anyone 12 and younger MUST be accompanied by a paying adult (age 18 years+) to enter into the Activity/Maze areas. Although most of our activities are staffed, they are not supervised. Your safety is important to us, and we are sure you will have fun playing alongside your children as well!
Farm Animals: Although we are excited for you to meet our farm animals, please remember we are not a petting zoo. The animals are friendly but also unpredictable. We recommend children and adults do not reach over or through our animal fences. Hand-sanitizing stations and hand-washing sinks are available in the animal areas and we always recommend washing hands after visiting the animals.
Smoking: For the safety of everyone, smoking (including e-cigarettes and vaping) is prohibited throughout the farm.
Allergies: Please be aware of the possibility of farm animal, hay/straw, corn, and other environmental-related allergy exposures while on the farm. More information is available about food ingredients at each venue upon request. Please see first aid below.
First Aid: Limited basic assistance is offered as a convenience to our guests while on the farm. It is not intended to replace professional medical care. Personal medical devices such as inhalers and epi-pens are recommended to be on people (including within field trips) at all times, as there may be environmental triggers on the farm. These devices are not available from first aid. Incidents will be documented on an incident report, but that is NOT intended as any type of agreement between parties. Harbes Family Farms reserves the right to contact additional professional medical services, such as 911, as determined necessary.
Working Farm: Harbes Farms are working farm operations. Although the farm operations are separated from the guest areas, it is still on the same property. Please advise children to never approach working farm equipment and be cautious of the possibility of farm equipment near guest areas.
Lost Children: Harbes Farms is aware of the possibility of children wandering away from their party. Although supervision is the guardian’s and teacher’s responsibility, the farm will respond quickly when a child is missing from their group. Please inform children that if they get lost, they can contact any employee for assistance. Teachers are expected to have an initial and final child count before arrival and departure. We appreciate your cooperation.
Jumbo Jumpers Bounce Pillows: This attraction is intended for use by people in good general health. For the safety of others, there is a weight restriction of 250 pounds per person and the number of jumpers at one time is limited. It is not recommended for use by those who have had recent surgery, heart history, high blood pressure, neck or back injuries or problems, leg or ankle injuries or weakness, dizziness, seizures, motion sickness, or any other health issues that could be aggravated by strenuous activities such as jumping. It is not recommended for pregnant women. Children under the age of 2 are not permitted on the Jumpers. Jumpers are responsible for themselves and the children who accompany them. Parents are responsible for children jumping on the pillow, even if they are not jumping. Flips and somersaults are prohibited.
Corn and Hedge Mazes: Guests 12 and younger must be accompanied by a paying adult (18 years+). Corn mazes are not intended for those with recent surgery, heart history, high blood pressure, anxiety, claustrophobia, panic attacks, mobility limitations, dizziness, seizures, severe environmental allergies or any other health issues that could be triggered by long-distance walking and a disorientation to location. Our mazes are monitored, but every guest’s exact location in a maze is not being monitored.
Hayrides: While on a hayride, please remain seated at all times. Parents must supervise children at all times. Do not lean over the railing and please keep your head and limbs inside at all times. Pregnant women be advised – the hayride can be bumpy.
